VO Health Terms of Service Effective Date: April 21, 2026
1. Acceptance of Terms
By accessing or using any services offered by VO Health ("VO Health," "we," "us," or "our") at vohealth.co, including purchasing tests or scheduling appointments, you ("Client," "you") agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Services Provided
VO Health offers the following services:
VO₂ Max testing and interpretation support — maximal aerobic capacity testing administered by trained staff, and/or personalized interpretation of results.
Blood biomarker testing performed at our CLIA-certified laboratory in Connecticut, or through partnership with an omics-based provider in Boston, MA, Montreal, Canada, or Salt Lake City, Utah
Blood biomarker analysis and interpretation — review and explanation of blood test results by qualified personnel, or with a trained AI algorithm
All services are provided for informational and wellness purposes only. VO Health does not provide medical diagnoses, prescribe treatments, or practice medicine.
3. Not a Substitute for Medical Care
The results, reports, and interpretations provided by VO Health are for general health and wellness informational purposes only. They do not constitute medical advice, diagnosis, or treatment. You should always seek the guidance of a licensed physician or qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it based on information received from VO Health.
4. Laboratory Services & CLIA Certification
Blood biomarker testing is performed at our CLIA-certified laboratory located in Connecticut. All testing is conducted in compliance with applicable federal and state regulations governing clinical laboratory services. Results are reported as generated by the laboratory and are subject to the limitations inherent in clinical testing, including but not limited to sample quality, collection method, and biological variability.
For certain tests outside of our in-house test menu, we may partner with academic or industry collaborators that can expand our testing capabilities. These partners may perform CLIA-certified tests, or novel molecular tests suitable for wellness insights without diagnostic capabilities.
VO Health is not responsible for inconclusive or invalid results due to improper specimen collection or handling by the client.
Data generated through your use of our laboratory services, including both in-house and partner laboratory testing, is subject to the data rights and licensing provisions described in Section 7 of these Terms. By purchasing any laboratory service from VO Health, you acknowledge that such data may be de-identified and used for research and commercial purposes as described therein.
5. Eligibility
You must be at least 18 years of age to purchase or use VO Health services. By using our services, you represent and warrant that you meet this requirement. VO Health reserves the right to refuse service to anyone at its sole discretion.
6. Purchases, Payments & Refunds
All purchases are processed securely through Stripe. By completing a purchase, you agree to the following:
Payments are due in full at the time of purchase.
All sales are final once a test kit has been shipped, a specimen has been received, or an appointment has been completed.
VO₂ Max testing appointments canceled with fewer than 24 hours' notice may not be eligible for a refund.
If a test cannot be completed due to an error on our part, we will offer a re-test or full refund at our discretion.

7. Privacy & Health Information
VO Health is committed to protecting your health information. Any personal health data collected through our services is handled in accordance with our Privacy Policy and applicable law, including the Health Insurance Portability and Accountability Act (HIPAA) where applicable.
We collect the following categories of data in connection with our services: identity and contact information, payment information (processed and stored by Stripe), health and biometric data generated through testing, and usage data from your interactions with our platform.
We do not sell, rent, or share your personally identifiable health information with third parties without your explicit consent, except as required by law or as necessary to perform the services you have purchased.
By accepting these Terms, you acknowledge and agree that VO Health may de-identify data derived from or generated through your use of our services, including data generated through any paid testing services or commercial laboratory activities, in accordance with applicable law and industry-accepted standards. Once data has been de-identified, it is no longer considered your personal data. You hereby grant VO Health a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable right and license to use, reproduce, modify, create derivative works from, combine with other data, commercialize, distribute, license, and sell such de-identified data for any lawful purpose, including but not limited to scientific research, product development and improvement, training and validation of algorithms and artificial intelligence models, benchmarking, publication, and commercial partnerships with third parties. You acknowledge that you will not receive any financial benefit, compensation, or royalties arising from VO Health's use of your de-identified data. VO Health will not attempt to re-identify de-identified data. Prior to sharing de-identified data with any third-party research or commercial partner, VO Health will enter into a written data use agreement with such partner that prohibits re-identification of the data, restricts downstream sharing without VO Health's prior written consent, requires the partner to maintain appropriate data security standards, and limits the partner's use of the data to the purposes for which it was shared. VO Health is not responsible for any breach of such agreements by third-party recipients acting outside the scope of their authorized use.
8. Results & Turnaround Time
Results are delivered to your secure online portal within 5–30 days of specimen receipt or appointment completion, depending on the service. VO Health is not liable for delays outside of our reasonable control.
9. Limitation of Liability
To the fullest extent permitted by applicable law, VO Health and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including reliance on any test result or interpretation, or arising out of or related to VO Health's use, processing, de-identification, or commercialization of data generated through your use of our services in accordance with these Terms.
Our total liability to you for any claim shall not exceed the amount you paid for the specific service giving rise to the claim. For any claim arising out of VO Health's use of de-identified data, our total liability shall not exceed the amount you paid for the specific service from which such data was derived.
VO Health does not warrant that test results will be error-free, that reports will meet any specific clinical standard, or that use of our services will produce any particular health outcome. All results are provided "as is" for informational purposes only.
10. Intellectual Property
All content, methodologies, report formats, software, algorithms, and materials produced or used by VO Health in connection with its services are the exclusive intellectual property of VO Health or its licensors. This includes but is not limited to testing protocols, interpretation frameworks, and the design of any reports delivered to you.
Upon payment, you receive a personal, non-transferable, non-exclusive license to use and retain your individual results and reports for your own personal, non-commercial purposes. You may not reproduce, distribute, sell, publicly display, or create derivative works from VO Health's proprietary materials, algorithms, methodologies, or reports without our prior written consent.
You retain ownership of the personal data you provide to VO Health. By using our services, you grant VO Health a limited, worldwide, royalty-free license to process and use your identifiable personal data solely as necessary to (i) deliver the services you have purchased, (ii) maintain, secure, and improve those services, and (iii) comply with our legal and regulatory obligations. The collection, use, and licensing of de-identified data derived from your use of our services is governed exclusively by Section 7 of these Terms.
All research findings, analyses, publications, models, algorithms, and any other derivative works created by VO Health through the use of de-identified data generated from our services — including data derived from paid testing services or commercial laboratory activities — are and shall remain the exclusive intellectual property of VO Health. No right, title, or interest in any such research outputs or derivative works is transferred to you by virtue of your use of our services or your provision of data in connection therewith, and you shall not be entitled to any compensation, royalties, or other financial benefit arising from VO Health's development, commercialization, or publication of such outputs.
11. Indemnification
You agree to indemnify and hold harmless VO Health and its affiliates, officers, employees, and agents from any claims, losses, liabilities, damages, or expenses (including reasonable legal fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.
12. Changes to These Terms
VO Health reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.'
13. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions.
In the event of a dispute arising out of or relating to these Terms or your use of VO Health services, the parties agree to first attempt to resolve the matter informally by contacting VO Health at hello@vohealth.co. If the dispute is not resolved within 30 days, either party may pursue their claims exclusively in the state or federal courts located in Connecticut. You consent to the personal jurisdiction of such courts and waive any objection to venue.
14. Acceptance of These Terms
By completing a purchase through VO Health, whether on vohealth.co or through our payment processor Stripe, you confirm that you have read, understood, and agree to these Terms of Service in their entirety, including without limitation the data rights and licensing provisions set forth in Section 7 and Section 10.
At checkout, whether completed on vohealth.co or through Stripe's payment platform, you will be asked to check a box acknowledging your agreement before payment is processed. By checking that box, you are expressly acknowledging and agreeing that: (i) VO Health may de-identify data generated through your use of our services, including paid testing services and commercial laboratory activities, and use such de-identified data for research, commercial, and other lawful purposes as described in Section 7; (ii) any research outputs, models, or derivative works created using your de-identified data are the exclusive intellectual property of VO Health as described in Section 10; and (iii) you will not receive any financial benefit, compensation, or royalties arising from VO Health's use of your de-identified data.
You acknowledge that regardless of the platform through which your purchase is completed, these Terms govern your relationship with VO Health and your use of our services. If you do not agree to these Terms, including the data rights described above, do not proceed with your purchase.
